2017 Update — Prepping for Increased CRA Review of Real Estate Investors

The hot real estate market in 2015 & 2016, particularly in B.C. and Ontario, has focused government and media attention on the real estate sector and real estate investors. In response, in October 2016, the CRA issued a public statement highlighting its increase in tax audits of real estate investors during 2015 and 2016, as well as its plan for a further, significant ramping-up of targeted audit activity in 2017 and the coming years.

Also in this statement, the CRA specifically noted fives areas of focus: property flipping, unreported capital gains on dispositions of properties, unreported GST and GST rebate claims in respect of new of substantially renovated housing, questionable sources of funds used to acquire properties, and unreported worldwide income of property owners.

In step with increased enforcement by the CRA, on October 3, 2016 the Department of Finance proposed changes to the principal residence exemption rules.  Furthermore, and importantly, Finance indicated that, starting with dispositions in 2016, taxpayers are required to disclose information to the CRA regarding all dispositions of principal residences (this requirement was previously on the books but has not been historically enforced by the CRA).

In expectation of increased tax audits of real estate investors, George Dube will review the applicable tax rules in the areas where the CRA is focusing its attention, so that REIN members can make fully-informed decisions when reporting their real estate investment activities on their tax returns.

In addition, George will revisit common issues focused on by CRA auditors when conducting tax audits of real estate investors, with the goal of providing you with the information you need to survive (and thrive!) in the event you are audited.
