Buyers and sellers, be aware. Don't get caught !

Did you know that realtors have new forms? In September 2016 there were major changes to contracts and addenda. Barry McGuire wants to make sure you don't get caught by these changes as they will affect both buyers and sellers.

For sellers there are a number of things to be aware of. Firstly sellers MUST provide vacant possession on completion day. You can no longer use “subject to tenants' rights”. Also as a seller you can void a contract if the buyer does not pay a deposit. You must also disclose any known government notices or lack of permits. Keep in mind, if you are married but on the title by yourself you need to get your spouse's Dower Consent or the buyer will be able to void the contract. Now sellers will be warranting to buyers that the property complies with any restrictive covenant. 

As a buyer there are just as many changes you need to take note of. You will no longer have to state what mortgaging you are getting; it will just be a deposit and a purchase price. You can't rely on seller diligence – you must do your own, you are now more clearly responsible for the cost of satisfying your own conditions, and you must use a licensed home inspector (not your carpenter brother-in-law). Overall this means more disclosure by the seller, and therefore it is an improved contract for you as the buyer.
